Terms and Agreement - Acceptance Policy
EayOK Hosting & More is owned and operated by Oksana Studios. Your domain hosting and/or membership to "members only" payment on your account (s) are made payable to Oksana Studios. This agreement is binding and will govern your purchase and use of any EayOK Hosting & More and/or EayOK Members Only (collectively called "Plan (s)". Your account will also be referred to as your "Plan (s)") as described in the Order Form, ordered by you and accepted by EayOK Hosting & More (eayok-hosting.com, EayOK Members Only). Hosting Details explains the terms and conditions that apply to your purchase and the use of the Plan (s) together with this Terms and Agreement Acceptance Policy. It is required that you accept these terms and conditions in order to register at Client Registration and use the Plan (s). By making your payment means that "I have read, understood and accept the EayOK Hosting & More Terms and Conditions" (also known as Acceptance Policy) you acknowledge that you have read this agreement and agree to be bound by the terms and conditions contained in this document as well as all policies and guidelines incorporated by reference. You agree that the act of submitting your order form online is equivalent to your signature. You agree that all the information you submit online is true and correct. Whether you choose a "Hosting Plan" or "Members Only Plan" the below applies to you.

Requirement for Hosting Plans: Use of the Hosting Plan/Subscription requires a certain amount of knowledge in the use of Internet Programming Languages, protocols and software, etc... This knowledge will vary depending on the usage and content level of your website. You or your webmaster must have the knowledge necessary to maintain your website, as it is not EayOK Hosting & More's responsibility to advise, teach, supply or provide any such knowledge or customer support outside of the Plan (s) agreed to you by EayOK Hosting & More Hosting & More.

Acceptable Use for Hosting Plans: Use your common sense as a guide to acceptable use of EayOK Hosting & More services and our servers. You should carefully read terms and the Guidelines in Hosting Details, as by registering for hosting you will be bound by these Guidelines and any modifications made to said documents. EayOK Hosting & More reserves the right to terminate your Subscription (s) without prior notice if you, in any way, should violate any part of the Terms/Guidelines set on any page in eayok-hosting.com or this Agreement.

Unacceptable Use for Hosting Plans: You shall not use the hosting plans in any way that violates U.S State Laws, Federal Laws and U.S. export laws, including without limitation, uses related to the distribution of weapons of mass destruction, prohibited chemical, biological, or nuclear weapons or missile use. You agree that you are not located in, under control of, or a national or resident of any country restricted as a destination by US law or on the US Treasury Department's list of Specially Designated Nationals or the US Department of Commerce's Table of Denial Orders.

Unacceptable Content for Hosting Plans: You are NOT allowed any of the following content to be stored on its servers: Illegal Material - Includes copyrighted works, non copyrighted works, commercial audio, warez, video, or music files, audio streaming, "file dumping" and any material in violation of any Federal, State or Local regulation.
a) "file dumping"
The posting of files for download or storing of files for distribution commercial or non commercial.
b) Chat scripts or Irc bots, spamming activities and message boards.
c) Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of EayOK Hosting & More.
d) Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Subscription Term: This agreement will be for the "term" of twelve (12) or twenty-four (24) months, beginning from the moment you register for the Subscription (s) - This agreement term is also reflected in other pages of eayok-hosting.com with a current term which may be 12 months or 24 months. This agreement and your Subscription (s) will be automatically renewed at the expiration of the term unless you followed the instructions described in the Termination Policy below.

Termination Instructions: To terminate (cancel) your Hosting Plan, you must provide EayOK Hosting & More written documentation for your termination from our servers by fax, email or mail, 7 days in advance of the removal of yoursite.com before your renewal date. EayOK Hosting & More will then ask you for customer identification information so that we can properly identify you and delete your plan (s) from our servers. Refunds are only available if you cancel before our 30 day guarantee. Canceling any time after the guarantee period of 30 days, there are "No Refunds."

Payment: All charges for your Subscription (s) must be paid in advance according to the most current price of the Subscription (s). Upon registration, you must pay for your Subscription (s) through our current merchant. Upon paying for your Subscription (s), you thereby grant permission to EayOK Hosting & More to charge any fees in accordance with your Subscription (s). Your Subscription will be renewed by you within two (2) weeks before your renewal date if you do not get an automatic renewal from our merchant.

Hosting Subscription Warrantee: You have 30 days to decide whether or not you want to remain as our hosting or MemberOnly subscriber. If within the 30 days you are not happy with our service, your hosting fee will be returned to you. However, the setup fee cannot be returned as the monies are paid to the person who sets you up on our servers. Paid subscribers who paid $50 for the first year to MembersOnly also have 30 days to cancel and receive 50% off the $50 cost. We can not offer any money back on our other MembersOnly offers which include special offers from another domain.

EayOK Hosting & More and MembersOnly: You acknowledge and agree that eayok-hosting.com (EayOK Hosting & More and MembersOnly) have the right to upgrade, downgrade or cancel any plans or the entire service at any time due to unfavorable circumstance. That "lifetime" means the lifetime of the existence of eayok-hosting.com as it exists in the whois directory currently until 2012. That eayok-hosting.com may or may not renew its domain. That if the domain is renewed, all subscribers are also renewed without extra cost other than the hosting plan subscribed to, including free hosting as it is stated in

Disclaimer: You acknowledge and agree that EayOK Hosting & More accepts no responsibility or liability for, and employs no control over, the content of the information passing through EayOK Hosting & More 's host servers, network hubs, or the Internet. All services performed thereunder are performed "as is" and without warranty against failure of performance including, without limiting to, any failure due to computer hardware or communication systems. It is also your responsibility to have your own virus protection on your computer. You also acknowledge  and accept that there may be an occasional human typographical error and EayOK Hosting & More cannot be held responsible for any mistakes on our hosting website: www.eayok-hosting.com.

Warranties and Representation: You warrant and represent to EayOK Hosting & More that you are: at least eighteen 18 years of age; you possess the legal right and ability to enter this agreement; you will use the Plan (s) only for lawful purposes and remain in accordance with this Agreement and all policies and guidelines that may apply; you will be financially responsible for your Subscription (s); you have acquired, or will acquire all necessary arrangements for hypertext links to a third party Web sites or other content; you have verified or will verify the accuracy of materials distributed or made available through use of the Plan (s), including, without limitation, your content, claims, warranties, guarantees, nature of business, and address where business is conducted, and your content does not infringe or violate any right of any third party (including intellectual property rights) or violate any applicable law, regulation or ordinance.
